Abstract

This paper studies references to case law in merger control decisions by the EC Directorate General for Competition (DG COMP) in 1990-2022. I use the full set of references to Court of Justice (CJEU) judgments in DG COMP decisions to examine implementation trends, industry dynamics and effects of the 2004 merger control reform. I show that the 2004 reform did not change the set of relevant CJEU case law in the European merger control regime and that there is no learning period associated with the implementation of new case law at DG COMP. I also show that merger waves are likely to drive citations of industry-specific case law, which could lead to the misconception that the relevance of CJEU case law to the European merger control regime tends to diminish over time.
